PRODUCT DISCLOSURE STATEMENT AND GENERAL MATTERS

INTRODUCTION

This document is a Product Disclosure Statement (PDS) for our Wedding Insurance Direct Insurance Policy and it is also the Wedding Insurance Direct Policy Wording.

This PDS is dated 9 March 2007 (ref:WED v1.1) and is issued by:

The PDS has been prepared to assist you in understanding the key features of the insurance policy and making an informed choice about your insurance requirements. This PDS sets out the significant features of the insurance policy including its benefits, risks and information about how the insurance premium will be calculated. You should read it carefully. You should also read the Policy Wording for full details of the terms, conditions and limitations of the insurance cover.

EXCLUSIONS

The Policy will not provide insurance cover under certain circumstances. For example, any loss arising from the bride or groom deciding not to marry as agreed or any loss arising from or any claim arising from suicide or attempted suicide or self inflicted injuries. Full details of the exclusions appear in each Section and at page 20 of the Policy Wording. You should read the Policy Wording and make yourself aware of all the exclusions that apply.

CONDITIONS

There are things that you must do for your insurance cover to apply. For example, you must pay the premium. Conditions of cover are shown in certain Sections and at page 18 of the Policy Wording. You should make yourself aware of all the conditions that apply by reading the Policy Wording.

LIMITS OF COVER

Our liability is limited to the amounts shown in the certificate of insurance that we will issue to you. You need to decide if the limits of cover are appropriate for you. If they are not, you may be underinsured and have to bear part of any loss yourself.

EXCESSES

If you make a claim under the policy, you may be required to pay one or more excesses. The descriptions of these excesses and the circumstances in which they are applied are shown in the Policy Wording.

CALCULATION OF YOUR PREMIUM

The amount of premium that you pay for this insurance will depend on the level of cover that you require. Premiums are subject to Commonwealth and State taxes and/or charges. These include the goods and services tax and stamp duty. The amount of these taxes and/or charges will be shown on your policy schedule.

GST

If you are entitled to an input tax credit for the premium, you must inform us of the extent of that entitlement at or before the time you make a claim under this policy. We will not indemnify you for any GST liability, fines or penalties that arise from or is attributable to your failure to notify us of your entitlement (or correct entitlement) to an input tax credit on the premium.

The amount that we are liable to pay under this policy will be reduced by the amount of any input tax credit that you are or may be entitled to claim for the supply of goods or services covered by that payment.

If you are liable to pay an excess under this policy, the amount payable will be calculated after deduction of any input tax credit that you are or may be entitled to claim on payment of the excess. Otherwise, we pay the GST but the limits are inclusive of GST.

COOLING OFF PERIOD

There is a 14 day cooling off period. If you are not completely satisfied with your policy You can cancel it by contacting us in writing within 14 days of the date of issue of your policy. We will refund your premium less any non refundable government charges and taxes that we have paid. You do not have a right to cancel your policy if you make a claim for any incident within the 14 day period.

DUTY OF DISCLOSURE
What you must tell us

When answering our questions you must be honest and you have a duty under law to tell us anything known to you, and which a reasonable person in the circumstances, would include in the answer to the question. We will use the answers in deciding whether to insure you and anyone else to be insured under the policy, and on what terms.

Who needs to tell us?

It is important that you understand you are answering our questions in this way for yourself and anyone else whom you want to be covered by the policy.

If you do not tell us

If you do not answer our questions in this way, we may reduce or refuse to pay a claim, or cancel the policy. If you answer our questions fraudulently, we may refuse to pay a claim and treat this policy as never having been in force.

WHAT TO DO IF YOU HAVE A DISPUTE OR COMPLAINT

At Calliden we strive to make our customers happy. However, complaints do occur and when they do we try and resolve them as quickly and easily as possible.

You may contact us at any time if you are dissatisfied with any matter relating to your insurance with Calliden, including:

  • Our decision on your claim;
  • Our handling of your claim;
  • The service of our authorised representatives, assessors, loss adjusters or investigators;
  • Your insurance policy.

Call 02 9551 1111 and we will try and resolve your complaint straight away. If we can not, we will ask you to put your complaint in writing. You can write to us at:

How we resolve your complaint
  • Actioning of your complaint will be by an authorised staff member. If they are unable to resolve your complaint, the staff member will refer the matter to their manager for immediate attention;
  • Should your complaint still be unresolved, the manager will refer you to Calliden's internal disputes handling department;
  • The internal disputes handling department will acknowledge your complaint within 2 business days of receipt and will endeavor to resolve your complaint within a further 13 business days. They will advise you in writing of the outcome.
If your complaint is still unresolved

If we cannot resolve your complaint within 15 business days or you are not happy with our response to your complaint, you can seek an external review via our external dispute resolution scheme, administered by the Insurance Ombudsman Service (IOS).

This national scheme is for consumers, free of charge and is aimed at resolving disputes between insureds and their insurance companies.

PRIVACY STATEMENT

Calliden and Wedding Insurance Direct are committed to protecting the privacy of the personal information you provide to us. Any personal information you give us will be treated in accordance with the Privacy Act 1988.

We require personal information about you to assess your request for insurance and to administer your policy, and also to notify you about other services or promotions from time to time.

Unless we are required by law to provide personal information to others, your personal information will only be seen or used by:

  • our own agents, staff and contracted staff;
  • claims adjusters, lawyers and others appointed by us or on behalf of us for claims handling purposes, and
  • our reinsurers and reinsurance brokers (which may include persons or entities located outside Australia).

By submitting your personal information to us, you agree to us using and disclosing your personal information as outlined in this Privacy Statement. This consent to the use and disclosure of your personal information remains valid unless you alter or revoke it by giving us written notice.

If you do not provide the information requested, your insurance proposal may not be accepted, or we may not be able to administer your policy, or you may breach your Duty of Disclosure, the consequences of which are set out in the Duty of Disclosure Section of this document.

You can request access to the personal information we hold about you and, where necessary, you can notify us in writing of changes so we can ensure that the information we hold about you is accurate, complete and up-to-date.

From time to time, we may use your name and contact details to send you or your firm offers or information regarding our insurance services or promotions that may be of interest to you. Please let us know if you no longer wish to receive this information.

HOW TO TAKE OUT YOUR POLICY

Once you have selected your level of cover, paid the premium shown and we agree to provide cover, we will give you a Certificate of Insurance, which will entitle you to claim under the policy up to the relevant amounts for which you are covered.

To confirm any policy transaction, (if the Certificate of Insurance does not have all the information you require), contact Wedding Insurance Direct.

GENERAL INSURANCE CODE OF PRACTICE

We proudly support the General Insurance Code of Practice. The purpose of the Code is to raise standards of practice and service in the general insurance industry. WEDDING INSURANCE DIRECT INSURANCE POLICY

This is Your Wedding Insurance Direct policy wording. It sets out the cover available and the standard terms and conditions which apply. You need to read it carefully to make sure You understand it and that it meets Your needs.

You must pay Your premium and in the event of a claim, You must pay the applicable excess. You must comply with the conditions in the policy.

We will not pay You for anything excluded by the General Exclusions or under "What is Not Covered".

The Certificate of Insurance, this policy document and any written endorsements issued by Us, make up Your policy. If You are satisfied with the cover please retain these documents in a safe place.

CLAIMS AND ENQUIRIES

Claim forms are available on our website at www.weddinginsurancedirect.com.au, or by calling Wedding Insurance Direct on 02 8263 0462. Please note: For claims purposes, evidence of the value of the property insured or the amount of any loss must be kept.

Please complete the claim form and attach supporting documents, reports, receipts, valuations and other proof of ownership and value or amount of any loss, and send to the below address.

CLAIMS SERVICE

We endeavour to process Your claim within 10 working days of receiving a completed claim form and all the necessary documentation. If We need additional information, a written request will be sent to You within 10 working days.

WORDS WITH SPECIAL MEANINGS

ACT OF TERRORISM means any act, or preparation in respect of action, or threat of action designed to influence the government de jure or de facto of any nation or any political division thereof, or in pursuit of political, religious, ideological or similar purposes to intimidate the public or a section of the public of any nation by any person or group(s) of persons whether acting alone or on behalf of or in connection with any organisation(s) or government(s) de jure or de facto, and which:

  1. involves violence against one or more persons.
  2. involves damage to property.
  3. endangers life other than that of the person committing the action.
  4. creates a risk to health or safety of the public or a section of the public. or
  5. is designed to interfere with or to disrupt an electronic system.

ADDITIONAL COSTS means the difference between the original cost of the Wedding Services and/or Reception and the rearranged Wedding Services and/or Reception.

ADVERSE WEATHER means flood, bush fire, snow, cyclone, hail, severe electrical storm, earthquake, or fog that causes major disruption to travel services i.e. rail, plane, road or bus.

ATTENDANTS means non-professional participants in the Wedding Ceremony, who traditionally attend on the bride or the groom.

BRIDAL ATTIRE means clothing and accessories of a formal nature worn by the bride at the Wedding whether hired or owned.

CEREMONIAL ATTIRE means clothing and accessories of the groom, male and female Attendants and the parents of the bride and groom, whether hired or owned.

CERTIFICATE of INSURANCE means the document that We give You which sets out the details of Your cover. You will receive this document when You first take out this insurance.

CLOSE RELATIVE means Your, parent, parent in-law, step-parent, son, son-in-law, step-son, daughter, daughter-in-law, step-daughter, grandparent, grandson, granddaughter, brother, brother-in-law, step-brother, sister, sister-in-law or step-sister.

ELECTRONIC DATA means facts, concepts and information converted to a form useable for communications, display, distribution, interpretation or processing by electronic and electromechanical data processing or electronically controlled equipment and includes programs, software and other coded instructions for such equipment.

GEOGRAPHICAL LIMITS means anywhere in the world.

HOME means Your place of permanent residence in Australia.

LEGAL EXPENSES means reasonable legal costs and disbursements incurred by Your solicitor or a solicitor appointed by Us, with Our consent.

MARQUEE means the hired marquee, tent, gazebo or other outdoor structure being used for Your Wedding.

OCCUPATIONAL POSTING means posting of foreign office employees and military employees including civilian services to the military.

PERSONAL INJURY means:

  1. bodily injury, sickness or disease, including death, shock, fright, mental anguish, mental injury or disability;
  2. the effects of unlawful arrest, wrongful detention or false imprisonment; or
  3. the effects of wrongful entry or eviction or other invasion of privacy.

PERIOD OF INSURANCE means the time that You are covered by this insurance as specified in each section of this policy.

PRE-EXISTING MEDICAL CONDITION means any medical condition that, at the time the insurance is arranged, has resulted in a terminal prognosis or that was awaiting treatment or investigation in a hospital or awaiting the results of tests and/or medical investigations.

POLLUTANTS means any solid, liquid, gaseous or thermal irritant or contaminant, including but not limited to smoke, vapour, soot, fumes, acid, alkalis, chemicals and waste. Waste includes material to be recycled, reconditioned or reclaimed.

PROPERTY DAMAGE means:

  1. physical loss, destruction or damage to tangible property, including loss of use of that property at any time resulting therefrom; or
  2. loss of use of tangible property not physically lost, destroyed or damaged where such loss of use results from physical loss, destruction or damage to other tangible property.

PROPOSAL FORM means the form completed by You giving answers, particulars and statements in respect of the insurance required by You.

RECEPTION means the social gathering, including but not limited to, room hire and catering, which takes place on the Wedding Date and is held on the same day as the Wedding Ceremony, at which the Wedding Ceremony will be celebrated.

WEDDING means the Wedding Ceremony and Reception which takes place on the Wedding Date.

WEDDING CEREMONY means a ceremony which takes place on the Wedding Date which:

  1. creates a legally enforceable contract of marriage in Australia; or
  2. is a celebration or declaration of 2 persons committing to a lifelong partnership.

WEDDING DATE means the day specified in the Proposal Form and Certificate of Insurance for the Wedding to take place.

WEDDING GIFTS means gifts for the bride and groom presented for the purposes of celebrating the Wedding.

WEDDING PARTY means the bride and groom and any non-professional participants in the Wedding, traditionally the mother and father of the bride and groom and the Attendants.

WEDDING RINGS means the ring(s) exchanged by the bride and groom at the Wedding Ceremony.

WEDDING SERVICES means services traditional to the celebration of a Wedding, including, but not limited to, professional photography and/or professional video operation, floral arrangements, hired cars or other transport.

WEDDING SERVICES SUPPLIER means any person or business that provides services traditional to the celebration of a Wedding for a fee, including, but not limited to, professional photography and/or professional video operators, florists, transport providers or musicians.

WE, OUR, US means Calliden Limited ABN 43 110 186 224, AFSL 284889.

YOU, YOUR, YOURS means the bride and groom named in the Certificate of Insurance or, for the purposes of certain Sections, and where appropriate, any person who has paid or is contracted to pay for the Weddings Services and any costs or expenses arising from the Wedding Ceremony or Reception.

SECTION 1 PART A - CANCELLATION

What is covered

We will reimburse You, up to the amount shown in the Certificate of Insurance, for any non-refundable expenses incurred by You in respect of Ceremonial Attire, Bridal Attire, flowers, music, photographs, caterers, transport, accommodation and the services from any other Wedding Suppliers booked but not used as a direct result of the unavoidable cancellation or curtailment of the Wedding Ceremony or Reception as the result of:

  1. the booked venue for the Wedding Ceremony or Reception being unable to hold Your Wedding due to an outbreak of infectious or contagious disease, damage to the venue, murder or suicide at the premises or closure of the venue by any relevant authority;
  2. the death, injury or sickness of the bride or groom or Close Relative which would make holding or continuing the Wedding inappropriate;
  3. the failure of any Wedding Services Supplier that You have booked and paid for;
  4. accidental loss of or severe damage to Ceremonial / Bridal Attire which renders the items unwearable and the purchase or hire of reasonable alternatives is not possible;
  5. involuntary redundancy of the bride or groom or any Close Relative who would have made proven, significant, financial contributions on which the Wedding arrangements depend provided that the redundancy notice is received at least 8 Weeks after the issue of this policy and the redundancy is classed as a redundancy under current industrial relations law or legislation;
  6. the non-attendance at the Wedding Ceremony of the officiating minister, celebrant or registrar;
  7. the inability of the bride, groom or their respective parents or at least 50% of the Wedding guests to reach the Wedding Ceremony or Reception venue due to Adverse Weather.
SECTION 1 PART B - REARRANGEMENT COSTS (AUSTRALIA ONLY)
What is covered

If You have a valid claim under Section 1 Part A of this policy, We will also pay up to the amount specified in Your Certificate of Insurance to reimburse You for the reasonable Additional Costs You incur to rearrange the Wedding Ceremony and/or Reception and/or Wedding Services to a similar standard to the amount originally budgeted. We will reimburse You for reasonable Additional Costs provided that We agree to the Additional Costs in writing before they are incurred and Your Wedding is rearranged in Australia.

Period of Insurance

You are covered under this Section from the commencement date the policy to the completion of the Wedding.

Excess

You must pay the first $100 of each and every claim.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Cancellation and Rearrangement.

What is not covered
  1. Any amounts recoverable from any other source;
  2. Any claim arising from:
    1. the bride or groom deciding not to marry as agreed or failure to comply with legal requirements or Your failure to obtain the relevant legal documentation;
    2. Your financial circumstances or those of any person or company on whom the Wedding arrangements depend, except as provided for in 1(e) or (c) above;
    3. any government regulation or act, strike or labour dispute;
    4. unemployment other than redundancy as specified in 1(e) above;
    5. the inability of You or any Close Relative to obtain leave from employment to attend the Wedding;
    6. failure to notify the provider of any goods or services immediately after it is found necessary to cancel or curtail the Wedding Ceremony or Reception;
    7. Additional Costs that We have not agreed to in writing before they have been incurred;
    8. cancellation/curtailment or rearrangement of travel and/or accommodation arrangements made in respect of Weddings outside Australia;
    9. service in the armed forces of any member of the Wedding Party other than the unforeseen Occupational Posting of the bride or groom.
  3. Any claim arising directly or indirectly from injury, illness, or death of any person caused by:
    1. pregnancy or childbirth unless the expected date of confinement is more than 2 months after the Wedding Date;
    2. suicide or attempted suicide or self inflicted injuries;
    3. the influence of drugs (unless they are prescribed by a registered medical practitioner and used as directed by the medical practitioner for conditions other than drug addiction) or the effects of alcohol;
    4. flying (other than as a fee paying passenger), scuba diving, hang-gliding, parachuting, paint ball, driving in any kind of race, go-carting, bungee jumping, winter sports, rock climbing, abseiling, playing any sport professionally or participating in any dangerous recreational activities of any sort;
    5. the deliberate actions of any person at pre-Wedding celebrations for the bride or groom.
  4. Any loss or expense where the Wedding Ceremony, Reception or Wedding Services have been arranged or commenced against the advice of a medical practitioner.
  5. Any claim arising from weather conditions other than Adverse Weather conditions that prevent the bride, groom or their respective parents, or at least 50% of the Wedding guests from reaching the Wedding Ceremony or Reception venue;
  6. For any claims arising from more than one cancellation and/or rearrangement of the Wedding.
SECTION 2 - CEREMONIAL ATTIRE/BRIDAL ATTIRE
What is covered
  1. If Your Bridal Attire is lost or damaged while it is in Your possession or the possession of a Close Relative, We will pay to reinstate the Bridal Attire or at our option, replace the Attire or pay for You to hire reasonable alternative Attire;
  2. If Your Ceremonial Attire is lost or damaged, We will pay to reinstate the Ceremonial Attire or at our option, replace the Attire or pay for You to hire reasonable alternative Attire.
Period of Insurance
  1. For Bridal Attire, We will only pay to reinstate or replace the Bridal Attire if it is lost or damaged while in Your possession or of the possession of a Close Relative:
    1. in the three months before the Wedding Date;
    2. during the Wedding Ceremony; and
    3. during the taking of photographs immediately following the Wedding Ceremony by a professional photographer.
    4. For hired Bridal Attire, We will cover You for up to 48 hours after the commencement of the Wedding Ceremony.
  2. In respect of Ceremonial Attire, We will only pay to reinstate or replace the Ceremonial Attire if it is lost or damaged while in Your possession or of the possession of a Close Relative or member of the Wedding Party:
    1. in the 48 hours before the Wedding Ceremony;
    2. during the Wedding Ceremony; and
    3. during the taking of photographs immediately following the Wedding Ceremony by a professional photographer. In respect of hired Ceremonial Attire, We will cover You for up to 48 hours after the commencement of the Wedding Ceremony.
Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Ceremonial/Bridal Attire.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  1. Loss or damage which is insured by Your or Your Close Relative's home or contents insurance;
  2. Any loss by theft not reported to the police within 24 hours of the loss being discovered;
  3. Any amounts recoverable from any other source;
  4. Loss or damage by theft or attempted theft of any Ceremonial / Bridal Attire left in any unattended vehicle, unless the Attire is left in the locked boot or locked glove compartment of a motor vehicle, concealed from view and there is evidence of violent, visible and forcible entry;
  5. Loss or damage arising from wear, tear, fading, marking, gradual deterioration, depreciation or lack of proper maintenance of Bridal or Ceremonial Attire whether owned or hired;
  6. Loss or damage arising from the action of moths, insects or vermin, mildew, mould, sweat, atmospheric conditions or variation in temperature, or any process of cleaning, restoration or repair.
SECTION 3 - WEDDING GIFTS

What is covered under this Section

We will pay up to the amount stated in the Certificate of Insurance for loss of or damage to Wedding Gifts as a result of accidental damage, fire or theft while they are being stored by You or a Close Relative. This cover also applies while the gifts are in transit or on display at the Reception.

Period of Insurance

You are covered under this Section from seven days before the Wedding Ceremony to 24 hours after the Reception.

Limit of Liability

For tangible gifts, the most we will pay is $500 per gift, up to a maximum of the amount shown in the Certificate of Insurance for Wedding Gifts. For gifts of cash or vouchers, the most we will pay is the amount shown in the Certificate of Insurance for Wedding Gifts – cash and vouchers. At all times, our limit of liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Wedding Gifts.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  1. Loss or damage arising from the action of moths, insects or vermin, mildew, mould, atmospheric conditions or variation in temperature, confiscation, detention, wear and tear or gradual deterioration;
  2. Any loss (other than accidental damage) not reported to the police within 24 hours of the loss being discovered;
  3. Loss or damage which is insured by Your or Your Close Relatives' home or contents insurance;
  4. Loss or damage by theft or attempted theft of any Wedding Gifts left in any unattended vehicle, unless the Wedding Gifts are left in the locked boot or locked glove compartment of a motor vehicle, concealed from view and there is evidence of violent, visible and forcible entry;
  5. Loss or damage by theft or attempted theft of any Wedding Gifts left in Your home or at the Wedding Ceremony venue or Reception venue, unless there is evidence of violent, visible and forcible entry.
SECTION 4 – WEDDING RING(S), FLOWERS, ATTENDANT'S GIFTS, AND THE WEDDING CAKE
What is covered

We will pay up to the amount stated in the Certificate of Insurance for loss of or damage to Wedding Rings, Flowers, gifts for Attendants and the Wedding cake.

Period of Insurance
  1. For Wedding Rings, cover commences 7 days before the Wedding Ceremony and ends 24 hours after the Wedding Ceremony.
  2. For Flowers, gifts for Attendants and the Wedding cake, cover commences 36 hours before the Wedding Ceremony and ends 24 hours after the Reception.
Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Wedding Rings, Flowers, gifts for Attendants and Wedding cake.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  1. Any amounts recoverable from any other source;
  2. Theft of Wedding Rings, Flowers and gifts for Attendants unless such items were removed by visible and forcible means;
  3. Any loss (other than by accidental damage) not reported to the police within 24 hours of loss being discovered;
  4. Loss or damage which is insured by Your home or contents insurance;
  5. Loss of or damage to floral arrangements, or to the Wedding cake, that is covered by Section 1 of this policy;
  6. Losses resulting from contracts which are not in writing;
  7. Loss or damage by theft or attempted theft of any Wedding Rings, Flowers, gifts for Attendants or the Wedding cake, left in any unattended vehicle, unless the property is left in the locked boot or locked glove compartment of a motor vehicle, concealed from view and there is evidence of violent, visible and forcible entry;
  8. Loss or damage arising from confiscation, detention, depreciation, wear and tear or gradual deterioration.
SECTION 5 – WEDDING CARS AND TRANSPORT
What is covered

We will pay up to the amount stated in the Certificate of Insurance if a private hire firm or individual with whom the transport arrangements have been made for travel by the Wedding Party to and from the Wedding Ceremony and/or Reception and who You are paying a fee fails to meet its/their contractual obligations.

Period of Insurance

You are covered under this Section from the commencement date of the policy until completion of the Wedding.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Wedding Cars and Transport.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  • Any amounts recoverable from any other source;
  • Losses which are covered by Section 1 of this policy;
  • Losses resulting from contracts which are not in writing;
  • Any costs which would have been incurred had the original supplier of the transport not failed to meet their contractual obligations;
  • Bankruptcy, insolvency or financial failure of any service provider.
SECTION 6 – PHOTOGRAPHY AND VIDEO
What is covered

We will pay up to the amount stated on the Certificate of Insurance to reimburse You for unforeseen expenses necessarily incurred to take/re-take Wedding photographs or videos or

any non-refundable amount which You originally contracted to pay as a direct and necessary result of:

  1. Non-attendance for any reason of the professional photographer or professional video operator contracted for the Wedding;
  2. Loss of or damage to the original film or negatives, or the digital media on which the photographic images are being stored by the professional photographer or professional video operator contracted for the Wedding, before copies are made;
  3. Non-development of the original film or negatives or non-development of whatever digital media on which the photographic images are stored (other than as a result of under or over exposure) by the professional photographer or professional video operator contracted for the Wedding.

If it is planned to take photographs of the bride and groom cutting the Wedding Cake, We will also pay up to the amount stated in the Certificate of Insurance to arrange an alternative photographic session necessitated by damage to the Wedding Cake, occurring within 48 hours before the conclusion of the Reception.

Period of Insurance

You are covered under this Section from the date of commencement of the policy until completion of the Wedding.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Photography and Video.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  1. Amounts recoverable from any other source;
  2. Losses which are covered by Section 1 of this policy;
  3. Any costs which would have been incurred had the original supplier not failed to meet their contractual obligations;
  4. Losses resulting from contracts which are not in writing;
  5. Bankruptcy, insolvency or financial failure of any service provider.
SECTION 7 – FAILURE OF SUPPLIERS
What is covered

Following the bankruptcy or liquidation of any pre-booked Wedding Services Supplier, We will pay up to the amount stated in the Certificate of Insurance for the following:

  1. Irrecoverable deposits;
  2. Additional costs in arranging alternative equivalent services.
Period of Insurance

You are covered under this Section of the policy from the date of commencement of the policy until completion of the Wedding.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Failure of Suppliers.

What is not covered under this Section
  1. any amounts recoverable from any other source;
  2. any costs which would have been incurred had the original supplier not ceased trading.
SECTION 8 – PERSONAL LIABILITY

In this Section:

‘YOU' and ‘YOUR' means the bride and the groom named in the Certificate of Insurance.

‘GEOGRAPHICAL LIMITS' means anywhere in the world other than the United States of America or Canada or their territories, protectorates or dependencies.

What is covered under this Section

We will pay up to the amount stated in the Certificate of Insurance in respect of Your legal liability for accidental Personal Injury and accidental Property Damage occurring within the Geographical Limits during the Period of Insurance and arising out of or in connection with the Wedding.

We will also pay any legal costs and expenses that We incur or You incur with our written consent, in the investigation, settlement or defence of any claim made against You for which You are covered under this policy.

Period of Insurance

You are covered under this Section of the policy from the date of commencement of the policy until completion of the Wedding.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Personal Liability inclusive of claim and defence costs.

What is not covered
  1. Loss or damage to any property belonging to You or in Your care, custody and control other than:
    1. personal effects of any visitors to or participants in the Wedding;
    2. vehicles (not owned, hired or loaned to You) in any carpark that you are responsible for;
    3. premises and their fixtures and fittings that You have temporarily hired, provided the liability does not solely arise under any contract or agreement;
  2. Loss or damage to any goods or property sold, supplied, delivered, installed or erected by You and all costs of or arising from the need to repair, correct, improve, remove, rectify, replace or recall of:
    1. any such goods or property; or
    2. any defective work executed by You.
    3. Any liability arising directly or indirectly from:
    4. the ownership, possession, use or operation by or on behalf of You of any mechanically propelled or assisted vehicles, lifts, caravans, aircraft or watercraft;
    5. Any vehicle insured or required to be insured by any legislation or competent authority.
  3. Any liability assumed by You under any contract or agreement except where the liability would have been implied by law in the absence of the contract or agreement;
  4. Loss or damage to any underground services unless You have contacted the appropriate authorities to verify the existence of and location of underground services and have obtained from them a plan detailing the location of the services before the damage occurs;
    1. any liability arising out of claims made or actions brought in the United States of America, Canada or their territories, protectorates, or dependencies coming within the jurisdiction of the courts of the United States of America, Canada or their territories, protectorates or dependencies; or
    2. arising out of claims and actions to which the laws of the United States of America, Canada or their territories, protectorates, or dependencies apply;
  5. Loss or damage which is insured by Your home or contents insurance or any travel insurance policy.
  6. Any liability:
    1. for Personal Injury to any person employed by You or deemed by law to be employed by You; or
    2. imposed or implied by or under:
      1. any workers compensation act or any other similar law, act or ordinance relating to compensation for injury to any person employed by You or deemed by law to be employed by You;
      2. any industrial award, agreement or determination or any contract or employment or workplace agreement, to the extent that You would not have been liable in the absence.
  7. Any liability caused by or arising directly or indirectly out of or in connection with the molestation of, or physical or psychological interference with, any person.
  8. Any liability caused by or arising directly or indirectly out of or in connection with the rendering of or failure to render professional advice or service by You or on Your behalf or an error or omission in connection therewith, but this exclusion does not apply to:

    Personal Injury or Property Damage arising from the rendering of or failure to render professional advice or service, provided such professional advice or service is not given for a fee.
SECTION 9 - LEGAL EXPENSES

In this Section, ‘YOU' means the bride and the groom named in the Certificate of Insurance.

What is covered under this Section

We will pay up to the amount stated in the Certificate of Insurance for Legal Expenses incurred by You in the pursuit of legal proceedings by You or Your personal representative(s) for compensation and/or damages arising from or out of Your Personal Injury or death.

Period of Insurance

You are covered under this Section of the policy from 24 hours before the Wedding Ceremony to 24 hours after the Wedding Ceremony.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Legal Expenses.

Excess

You must pay the first $100 of each and every claim.

What is Not Covered:
  1. Any claim brought against Us or Our agents, Your Close Relatives or any members of the Wedding Party;
  2. Legal Expenses incurred prior to the written acceptance of a claim by Us or incurred without our consent;
  3. Any claim reported more than thirty one days after the commencement of the incident giving rise to such claim;
  4. Any claim where We consider there are not reasonable prospects of success in the pursuit of an action or proceedings;
  5. Claims arising in connection with Personal Injury or death occurring more than twenty four hours before or more than twenty four hours after the Wedding Ceremony;
  6. Claims for Legal Expenses where You are pursuing legal action relating directly or indirectly to medical negligence or alleged medical negligence;
  7. Claims emerging from the pursuance of a contingent fee agreement between You and Your solicitor or counsel;
  8. Pursuing claims as part of or on behalf of a group or organisation;
  9. Any claim arising from a Personal Injury or Your death if the Personal Injury or death occurred outside Australia;
  10. The pursuit of legal proceedings outside Australia;
  11. 1Any claim where the law applicable to the proceedings or action is other than Australian law.
Conditions of Cover
  1. Making a Claim
    You must obtain and send to Us at Your expense a written opinion from Your solicitor which addresses the following:-
    1. the facts of the claim;
    2. the law applicable to the dispute;
    3. the prospects of successfully pursuing or defending the claim or legal proceedings;
    4. the estimated Legal Expenses for pursuing or defending the proceedings;
    5. the fee structure and any costs agreement (actual or proposed) in relation to legal services directly connected to the dispute.

      We will pay the reasonable cost of obtaining this opinion if We agree to pay Legal Expenses under this Section.
  2. Legal Representation
    1. Upon making a claim You nominate a Solicitor of Your choice. We reserve the right to refuse Your nomination of a solicitor without giving any reason and direct you to retain another solicitor either of Our or Your choice.
    2. We reserve our right to direct You to terminate the services of Your solicitor if it is in Your interests. You must terminate the services of the solicitor and a new solicitor shall be appointed to act for You either nominated by You or appointed by Us.
    3. We reserve our right to take over and conduct the claim or legal proceedings in Your name.
  3. Claim Administration and Control
    1. We must have direct access to Your solicitor at all times. You must co-operate fully with us in all respects and keep us fully and continually informed of all material developments in the legal representation or proceedings. If we ask, You must instruct Your solicitor to produce to Us immediately any documents, information or advice in their possession and You must give them any instructions in relation to the conduct of the claim We may require.
    2. We are only liable for the costs or fees of counsel, accountants or any expert witness if We have given our consent to the appointment of that person and agreed the proposed fee.
    3. Any Legal Expenses We may agree to pay will not be affected by any agreement, undertaking or promise made or given by You to Your solicitor or to any counsel, witness, expert or agent.
    4. Your solicitor or You must inform Us immediately in writing of any offer or payment into court made with a view to settling the claim and:
      1. no agreement to settle must be made without our prior consent;
      2. if You do not accept any offer or payment into court but that amount is equal to or in excess of the total damages eventually recovered by You, We shall have no liability in respect of any Legal Expenses incurred after that offer or payment unless We agreed to the continuation of the legal proceedings after being advised of the offer or payment into court.
    5. On our request, You must require Your solicitor to have the Legal Expenses taxed, assessed or audited by a costs assessor or any relevant authority.
    6. If for any reason Your solicitor refuses to continue acting for You or if You withdraw Your instructions from Your solicitor then any liability We have will finish immediately unless in our discretion We agree to the appointment of another solicitor to continue with the claim.
    7. If You withdraw from the claim without our prior consent then the Legal Expenses will become Your responsibility and We will be entitled to be reimbursed by You for any Legal Expenses.
    8. Where You are awarded costs, You must take steps to recover Legal Expenses. Any recoverable Legal Expenses, whether recovered or not, will be taken into account for the calculation of our liability under this policy.
    9. If You settle a dispute and the settlement amount includes Legal Expenses, We will be entitled to be reimbursed by You for such Legal Expenses.
  4. Dispute Resolution
    1. If We direct You, You must use any Alternative Dispute Resolution (ADR) process available before taking legal action in respect of an insured dispute.
    2. You must use Your best endeavours to have any dispute resolved through ADR and propose the use of ADR to other parties to the dispute.
SECTION 10 – MARQUEE COVER

In this Section ‘Period of Hire' means four days unless We have agreed otherwise in writing.

What is covered

We will pay You up to the amount stated in the Certificate of Insurance in the event of loss of or damage to the Marquee or caused by the marquee, arising from any cause not specifically excluded, occurring during the Period of Hire anywhere in Australia. Cover under this Section includes cancellation/curtailment and rearrangement as a direct result of loss of or damage to the Marquee.

Period of Insurance

You are covered under this Section of the policy for the Period of Hire.

Limit of Liability

Our liability to pay any claim under this Section will not exceed the amount stated in the Certificate of Insurance for Marquees.

Excess

You must pay the first $100 of each and every claim.

What is not covered
  1. Any amounts recoverable form any other source;
  2. Loss or damage arising from erecting and/or dismantling of any hired property;
  3. Loss or damage to audio visual entertainment equipment;
  4. Damage to flooring caused by footwear;
  5. Theft of ancillary equipment unless there is violent and forcible entry or exit from the locked premises where the Marquee has been erected;
  6. Loss or damage caused by any government regulation or act;
  7. Theft or attempted theft unless involving forcible or violent entry to or exit from a building;
  8. Loss or theft from any unattended venue or vehicle;
  9. Any loss or damage occurring after a period of four days hire, unless We have agreed otherwise in writing;
  10. Losses which are or but for the existence of this policy would be otherwise insured;
  11. 1Loss, damage or liability resulting from any structural or inherent defect in the Marquee;
  12. 1Loss or damage which is insured by You or Your Close Relatives' home or contents insurance;
  13. 1Loss or damage occurring outside Australia.

CONDITIONS APPLYING TO ALL SECTIONS OF THIS POLICY

As a precondition to Your entitlement to cover under this policy, You must comply with these conditions. If You do not comply, We reserve our rights to refuse to pay a claim or reduce (in some cases to nil) the amount You would otherwise be entitled to receive.

  1. Claims Procedures
    1. After any accident or event which may result in a claim under this policy, You must contact Us as soon as possible to tell Us what has happened and complete a claim form and return it to Us as soon as possible if We ask You to.

      Additional action then depends on the type of claim:
      1. theft, loss, malicious damage or vandalism – tell the Police immediately;
      2. legal liability for Personal Injury or damage – forward to Us immediately upon receipt any writ, summons or other legal process issued or commenced against You. You must not admit to liability or settle or attempt to settle any claim without our written consent;
      3. any event that may lead to a claim being made for retaking the photographs of the Wedding cake-cutting ceremony – notify Us within 48 hours of occurrence;
    2. You must provide Us, at Your expense, with all reasonable details and evidence which We ask for concerning the cause and amount of any loss, damage or injury (including invoices, proof of payment of deposits, receipts for Wedding gifts, money and vouchers, documents and certificates);
    3. If Your claim arises as the result of Your illness or death or the illness or death of a Close Relative, You must provide whatever medical evidence We may require;
    4. In the event of a claim, You must produce documentation to show that original contractual obligations with suppliers, or that ownership of goods, existed.
  2. Our rights of recovery and conduct of proceedings
    1. If a claim is made against You for anything covered under this policy, We have the right to conduct, defend or settle any such claim or legal proceedings and to act in Your name;
    2. We may attempt to recover the amount We have paid to You from someone else if We find they are responsible for Your loss or damage. If so, You must give Us Your rights to conduct, defend or settle any legal action against that person and to act in Your name;
    3. You have a responsibility to cooperate fully with Us, even if We have already paid Your claim, and You must give Us all the information that We require.
  3. Reasonable Care
    You must take all reasonable care and precautions to prevent theft, loss, damage or liability and injury to any person to minimise any claim under this policy and You must also make every effort to arrange an alternative venue for Your Wedding and obtain alternative Bridal and Ceremonial Attire and Wedding Services.
  4. Other Insurance
    If You have other insurance covering any loss recoverable under this policy, You must provide Us with details of the type(s) of other insurance and name(s) of the other insurer and provide Us with any information or assistance We may need to make a claim on the other insurer.
  5. Salvage and recoveries from third parties
    1. When We pay for any claim for the total loss of any tangible item, that item becomes our property;
    2. If We take proceedings in Your name to recover compensation or secure an indemnity from any third party in respect of any loss or damage covered by this insurance, and any amount recovered will belong to Us.
  6. Jurisdiction
    This policy is governed by the laws of the State or Territory where this policy is issued. The relevant courts of the place where the policy was issued will have jurisdiction in any dispute concerning or under this policy.

GENERAL EXCLUSIONS APPLYING TO ALL SECTIONS OF THIS POLICY

We will not pay for claims arising directly or indirectly from:

  1. Personal Injury or property damage in any way involving asbestos in whatever form or quantity;
    1. war, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, mutiny, civil commotion, coup, military rising, insurrection, military or usurped power, rebellion, revolution, confiscation, nationalisation, requisition or looting, sacking or pillage, destruction of or damage to property by or under the order of any government or local authority;
    2. death, injury, illness, loss, damage, cost or expense directly or indirectly caused by, contributed to by, resulting from or arising out of or in connection with any Act of Terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss;
    3. death, injury, illness, loss, damage, cost or expense directly or indirectly caused by, contributed to by, resulting from, or arising out of or in connection with any action in controlling, preventing, suppressing, retaliating against, or responding to any Act of Terrorism.; or
    4. nuclear weapons material or ionising radiation or contamination by radioactivity from any nuclear fuel or nuclear waste or from the combustion of nuclear fuel or from any other self-sustaining process of nuclear fission;
    5. Personal Injury or Property Damage or financial loss or loss of, damage to, or loss of use of property directly or indirectly arising out of the actual, alleged or threatened discharge, dispersal, release, seepage, migration, emission or escape of Pollutants;
    6. the cost of testing, monitoring, containing, removing, nullifying or cleaning up Pollutants except liability otherwise excluded under paragraph 3(a) that arises from a sudden identifiable, unintended and unexpected happening, which takes place in its entirety at a specific time and place;
    7. property damage to Electronic Data or caused by or arising directly or indirectly out of the total or partial destruction, distortion, erasure, corruption, alteration, misinterpretation or misappropriation of Electronic Data or any error in creating, amending, entering, deleting or using Electronic Data or total or partial inability or failure to receive, send, access or use Electronic Data for any time at all or any consequential loss resulting from;
    8. caused by or in connection with the use of an intranet or the Internet (including but not limited to the World Wide Web and electronic mail systems) by You or on Your behalf; or
    9. caused by or in connection with computer hardware or software that does not meet Year 2000 Conformity, within the meaning of that term in Miscellaneous Paper SAA/SNZ MP77:1998 "A Definition of Year 2000" published by Standards Australia and as amended or substituted from time to time.
  2. The confiscation, lawful seizure, nationalisation, damage, loss, destruction or requisition of anything insured by this policy by an authority who is legally able to do this;
  3. Any Pre-Existing Medical Condition or any facts, circumstances or occurrences that You were aware of before You purchased this policy, that You knew or should reasonably have known may give rise to a claim under this policy;
  4. The influence of drugs (unless they are prescribed by a registered medical practitioner and used as directed by the medial practitioner for conditions other than drug addiction) or the effects of alcohol;
  5. Consequential loss or damage of any kind;
  6. Injury, illness, death, loss, expense or other liability attributable to sexually transmitted disease;
  7. Any unlawful act committed by You or criminal proceedings against You or any other person on whom the Wedding plans depend;
  8. 1You or any person upon whom the Wedding plans depend, failing to follow the advice of a medical practitioner;
  9. 1Anxiety, stress or depression unless You are admitted as an in-patient at a recognised hospital;
  10. 1The ownership or use of:
    1. bouncy castles and other inflatables; or
    2. firearms, fireworks or other pyrotechnic devices or effects;
  11. Vaccinations.
We will not cover You for:
  1. Damage caused intentionally by You, or a person acting with Your express or implied consent;
  2. Fines, penalties, liquidated, aggravated, exemplary or punitive damages;
  3. The sentimental or intellectual value of any item;
  4. Wilful or malicious acts and any acts of vandalism by persons invited to the Wedding by You;
  5. Loss or theft from unattended venues or vehicles unless involving forcible or violent entry or exit;
  6. Loss of or damage to the property insured due to or arising from:
    1. wear and tear, inherent defect;
    2. rot, mildew, rust, corrosion, frost, soiling;
    3. insects, woodworm, vermin, moth;
    4. dyeing, renovation;
    5. electronic, electrical or mechanical breakdown, failure or derangement;
    6. faulty manipulation, design, plan, specification or materials;
    7. gradual deterioration, market depreciation;
    8. atmospheric conditions;
    9. shrinkage or change of colour;
    10. confiscation, detention or any process of cleaning, restoration or repair;
  7. Claims where the person whose condition causes the claim:
    1. was on a waiting list for in-patient treatment in a hospital or awaiting the results of tests and/or medical investigations before this insurance commenced;
    2. received a terminal prognosis before this insurance commenced;
  8. Any claims arising from or in any way connected to any incident that occurs before this policy is purchased.
